Terms of Use

These Terms of Use govern access to and use of the vinsvivus.com platform, published by Vins Vivus. They apply to every visitor and every account holder. The terms specific to purchasing a subscription or an allocation are set out in our Terms of Sale. These Terms of Use are drafted in French; this English version is provided for convenience only, and the French version prevails in the event of any discrepancy.

Article 1 — Purpose

Vins Vivus is a platform that connects wine domaines with wine lovers. The domaines on the platform are today located in Burgundy; other regions may be opened later. Each domaine offers its own subscription tiers and publishes its own allocations; purchases are made directly from the domaine, which remains the seller.

Article 2 — Access to the service

Access to the site's content (domaine names, tiers, prices, allocations) is reserved to people who have created an account. The public part of the site — the home page, the anonymised domaine register, the Guarantee page, and the legal pages — remains accessible without an account.

Creating an account is reserved to people who have reached the legal drinking age. A date of birth is requested at sign-up for this purpose.

Article 3 — Creating and managing your account

The account holder guarantees the accuracy of the information given when creating their account and undertakes to keep it up to date. An account is personal and may not be shared.

The account holder is responsible for the confidentiality of their credentials and for any activity carried out from their account.

Article 4 — Permitted use

The account holder undertakes not to divert the service from its purpose — in particular, not to create multiple accounts to get around the purchase limits set by domaines, and not to resell allocations obtained in a way that runs against the spirit of the service.

Article 5 — Intellectual property

Every element of the site (text, structure, visual identity) is protected by intellectual property law and remains the property of Vins Vivus or its licensors. No reproduction is permitted without prior agreement.

Article 6 — Purchases and subscriptions

Purchasing a subscription or an allocation is governed by our Terms of Sale, which take precedence over these Terms of Use on everything relating to price, payment, delivery and the Provenance Guarantee.

Article 7 — Service availability

Vins Vivus works to keep the service available at all times, without guaranteeing it will never be interrupted, including for maintenance. Vins Vivus cannot be held liable for a temporary unavailability of the service.

Article 8 — Deleting your account

An account holder may request deletion of their account at any time. Deletion anonymises their profile data; data linked to past orders is kept under the conditions described in our Privacy Policy.

Article 9 — Changes to these Terms of Use

Vins Vivus may amend these Terms of Use to reflect changes to the service or to the law. The version in force is the one published on the site.

Article 10 — Governing law

These Terms of Use are governed by French law.
